What should my boyfriend do?

He doesn't know that I'm asking this but I am very worried about this. He was working for his father and his father's partner about a year ago. His father came up to him and told him to sign a piece of paper just to say that my boyfriend was a witness to some loan they were taking. Now we find out that he wasn't signing as a witness, his father lied and he was really signing to take the loan out himself, because his father and his partner didn't have good enough credit to do it themselves. The amount was 155,000$. So now my boyfriend has this amount of debt on his name and his father never paid back the loan and left to another country to be with his mistress. We don't have enough money to pay this off and his credit is being ruined. We don't have enough for an attorney either. What could he do to take this off his name?

For starters, your boyfriend (no one) should ever ever sign a document that they don't fully understand, much less one that is blank. You need a lawyer asap...a good one. One possible out is that your boyfriend never received any money so how can he be responsible for the loan? And his father would not have been able to receive this on his behalf unless he had a notarized letter of permission...or he forged a document. He has no choice but to get a lawyer as this could ruin his future.

At the very least, he needs to contact the creditor and ask for proof that the monies were received (until they were, the contract is meaningless) by him (in other words, anyone can sign a contract but if the person giving the loan can't prove that someone received the loan, they won't be able to collect). The contract just states the terms of the loan but it isn't the actual receipt of monies and/or consideration received!

Trust me, you do need a lawyer...asap!

There is probably not much that he can do. It sounds like he signed as a co-signer on the loan, and now that the other party has fled the country he is left holding the bag.

Too bad. You have to read what you are signing.

Your boyfriend should have read the document before signing it. He would have to prove fraud before any legal action could be taken. Check with the lender, see if you can get a copy of the loan agreement, and why you never received a copy when the loan was approved.

Without money or a lawyer he is going to have a very difficult time getting anything done. He can try to call some law firms to see if they'd be willing to work probono, which means for free, or if they'd work for a significantly reduced amount of money. It will be very hard for them to get to his dad though considering he is out of the country. If he doesn't come back to the states nothing will be able to be done for him paying back the money.

Your boyfriend should have read what he was signing before he signed it and he wouldn't be in the mess. He is still fully responsible for it, even if he was dooped. He should have been smart enough to read it.
