What types of protest are legal?
Find answers to your legal question.

What types of protest are legal?

Free of speech is suppose to be our backbone. Why are so many arrested for protesting, even when its peaceful?

The freedom of speech act determined it was a CONDITIONAL right.
Yes, you heard it, CONDITIONAL.
In other words, we can say whatever we want. Which i thought was kind of the point.
We are all allowed opinions on political problems etc etc, but when it comes to protest. Thats different. You cant get in the way of anything, you have to apply for permission to protest and if the government say you cant do it and you do, police bludgen till you piss off home.
Free speech is a load of bollocks in my opinion. Even if you are allowed to show your opinion, it doesnt mean anyone with power will listen to you because for some reason they're all so far up their own arses they think they know what society want and need without listening to everyone in the society.

you have a right under the first amendment to "peacefully assemble" If you start burning and destroying things, then you get gassed.

We can protest in our own house.
If we smoke in the house, we have to stay away from the windows, so noone gets offended by seeing us smoke.
America is becoming a joke. And noones laughing.

usually not peaceful

Arrests are for 1) Failure to follow police instructions 2) Not having a parade permit. 3) Blocking the street or sidewalk 4) throwing rocks at police 5) failure to disperse 6) drug use 7) many other violation of law.

True peaceful protects that follow the law are not broken up. I have seen 1000's of them over the years.

all of them up to the point they turn into a riot because we have a constitutional right to protest and the police have the requirement to break up riots and when somebody is arrested for peaceful protests is a use of excessive force by the police force which can get the supervising officer i allot of trouble.

Its because the government want them to be thought that protesting isnt a way to solves problems even thou it peaceful the government are just dumb that when u protest and and get arrested and u know your right u can sue them.

And every pretest in some countries are illegal because the government think they are against them.

Disneyland Guru
Because they are breaking the law in one way or another. I see some of the "peaceful" protests on tv. People wearing black masks, throwing rocks, mexican flags. Yeah, real peaceful.

Any answers to your question would have to be contingent upon what those who are arrested are being arrested for. In the US, the First Ammendment to the Constitution protects our freedom of expression and freedom to assemble; but activities associated with freedom of speech and assembly is not always absolutely guarunteed.

“The conduct which is the subject to this statute—picketing and parading—is subject to regulation even though intertwined with expression and association. The examples are many of the application by this Court of the principle that certain forms of conduct mixed with speech may be regulated or prohibited.”

Without knowing which arrests you are referring to; my best guess is that people are being arrested for breaking laws based on their conduct...not for what they are saying. Blocking sidewalks, blocking access to buildings, failure to follow local ordinances regarding large assemblies are possible reasons for arrests.

“The privilege of a citizen of the United States to use the streets and parks for communication of views on national questions[p.1191]may be regulated in the interest of all; it is not absolute, but relative, and must be exercised in subordination to the general comfort and convenience, and in consonance with peace and good order; but it must not, in the guise of regulation, be abridged or denied.”

Depends on where and how the protests are staged and whether or not they are prior-approved by the authorities of the area!

The patriot act screwed people over, it was made within a few years after 911 when the bush admin made everyone there ***** through fear of terrorism. For more info google the patriot act. But you are right, looking back on all the hippie beating n what not that doesnt make sense.

If you cause violence that harms anyone or if you're one someone's private property while picketing, then they have the right to arrest you because while you're protesting, you're causing other people discomfort in one way or another.

It is an amusing question. The answer is not really known. I guess that if you get a permit before hand, they can't really do anything to you.

Have fun

You'd have to state a specific source- there may be other factors involved.
