I wouldnt pay it, i would appeal. If the appeal failed i still would not pay, and if it came down to it i would rather go to prison than pay, i know it sounds extreme but i for one am fed of of being discriminated against because i am a smoker. |

Ah heard about this on the radio this morning. I'm an non smoker haven't smoked in over 7 years but that doesn't mean I'm one of those 'nothing worse than an ex-smoker types'. I think it's terrible for this guy, it's his vehicle and he's got the right to smoke in it if he wants. I think someone was deliberately 'out to get him' to cause trouble for him. he must have thought he was on candid camera or something and must have felt like punching whoever handed him the fine. that's what i would have felt like. |

if its a work vehicle then u need to conince them it wasnt being used for work at the time, otherwise u'll prob have to pay up :-) |

Depends. You have not cited your own personal example. Are you in a city that has the law that you can't smoke in your vehicle with children in it? If so, and your were smoking in your car with children inside, then you deserve the ticket. But on the other hand, if you were alone, then it's complete BS. |

As it is a private vehicle, I'd be very annoyed with the people pulling me over for no good reason.
If it was a work vehicle, I'd be very annoyed at myself for being stupid and doing something illegal.
In both events, I would also be very surprised, as I don't smoke. |

that would never happen unless u were a taxi driver as its not illegal to smoke in your own car unless its used for public transport so i would be very shocked and wouldnt pay the fine but if i was a taxi driver and was caught smokin in my car (as most taxi drivers do) then i would accept my fine and pay the consequences for my stupidity and pray that my lively hood wouldnt be takin from me for my foolish mistake |

Non smokers answer, but...
If i wer to stopped by some proper police, and charged under the RTA with 'Driving without due care and attention', then its a fair cop. (There was a woman charged for drinking from a bottle whilst stopped at some lights recently).
However if its some rent a cop, plastic policeman, parking stazi, then absolutely not! |

The person was fine because he was caught smoking in what the law considers a place of work. What is crazy about this that vehicle used to transport material and tools should be caught up in what is otherwise a sensible piece of legislation. The same law applies to HGV drivers, the question when the cab is being used a the drivers sleeping quarters is it a place of work. |

If this was purely a smoking related incident, ie smoking in a confined space, then i think its wrong for this person to be fined as such.( on his own, not a works vehicle?)
on the other hand if this was something to do with a driving
matter,such as due care and attention, then he should be more careful when smoking whilst driving.
As for the ignorant selfish lot who continue to smoke in vehicles
when other people are present, (especially young babies)
who have to breathe in their foul poison, they should be ashamed of themselves. |
