Whats the legal speed if no signs are posted?
|
My friend lives on a country road in Kansas and there are no speed limit signs on his road - none at all - he was pulled over for speeding and he got a ticket. He wants to know if he can fight this or not. Before a bunch of you get all self righteous and judgmental like I've seen on other questions about speeding - he knows the safety of driving on roads and on the highway but on a road in the middle of nowhere everyone speeds. Anyways the Question is - What is the legal speed limit on a paved road in the country {in Kansas} where no signs at all are posted. Thank you all In Advance!
P.S Sources would really be appreciated Additional Details "did you take driving lessons" actually no i didnt - i'm not a driver - how about you read the question - i said "MY FRIEND" and "HE" pretty sure my picture looks like a girl! next thing is he wasnt on a highway - he was on a COUNTRY road - in the middle of NO WHERE - thank you people who can read

Here's a link for the driver's manual. You can find the speed limits on page 11 I think. Hope this helps. http://www.ksrevenue.org/pdf/dlhbsec1.pdf |

Did you take driving lessons? When I was studying to get my license, there was a little book that explained this in excruciating detail. It depends on whether it is a "thickly settled district".
See:
http://www.ksrevenue.org/pdf/dlhb.pdf
"SPEED LIMITS
Where no special hazard exists the traffic laws set up speed limits for normal driving
conditions. Unless otherwise posted maximum limits are:
In Towns or Cities:
Thirty miles per hour in any urban district.
On Roads and Highways Outside of Towns:
70 miles per hour on any separated multilane highway as designated and posted by
the Secretary of Transportation;
65 miles per hour on any State or Federal Highway;
55 miles per hour on any county or township highway." |

Each state has different basic speed limits when there is no sign posted. In my state the speed limit you described above would be 55 mph.
However, you can also get cited for speeding for driving too fast for conditions. |

The posting doesn't matter, if he was exceeding the State speed limit. Meaning, if he was over the highest speed in the State for that type of road, it is assumed you know it. After all, you have a license. Just like they assume you know to use your signal.
Here's a quick source for you:
http://en.wikipedia.org/wiki/Speed_limits_in_the_United_States
So, basically, if he was over 65, he's guilty. Speeding is strict liability, but he might win some sympathy if he was going 67 in a 55 and thought it was a 65 without any signs... |

I have no idea, but the speed limit is probably whatever the nearest speed limit sign says
your friend should have asked the officer what the legal limit was compared to how fast he was traveling.
if he wants to fight it, take pictures up and down the highway your friend was driving to show that there werent any speed limit signs, so he had no idea how fast to go.
if he was blatantly speeding over 90 i would say that is a little excessive, but you never know, just get evidence there was no sign anywhere that posted a speed limit so how can an officer give you a ticket
good luck, **** the police! |

Go to court and fight it if your friend is sure there are no signs. |
