When I was 18, I was out for my friend's birthday...?

Three of us went into a toilet to take some cocaine. Before I got to take any, we got caught. The bouncer came in and called the police. There was one friend who had half a gram of coke and half an ounce of cannabis, another friend who had snorted a line but had nothing on him and myself, who hadn't taken any and had none on me. The friend with stuff on him got a conviction; the other friend and I got a police caution. Was it lawful that I should have got a caution when I had nothing at all on me and hadn't touched the stuff?

You're missing the point. I am now 24. I realise the stupidity of doing it. I haven't touched the stuff since. It was only the second time I had tried (or intended to try it) then. I'm into drugs, I realise it was a wake-up call &c &c &c. What I want to know now is, intent or not, the police don't know what I intended, surely I had nothing on me so the caution I got- for possession of a controlled substance- was wrong. I wasn;t in possession!! The only reason I care now is that the law has changed saying it will never be wiped form my record and I want to go into teaching.

You should not have been cautioned! There was no possession, and an intention to take drugs is not an offence. However, for you to have been cautioned, you wouldhave needed to have agreed to it, which means that your chances of having it removed from your record are slim.

Yes as you were taking part in a crime. Drug taking is illegal and even though you did not get your turn you were locked in a toilet with 2 other guys and would of committed that offence had you not been caught. If you had no intention of taking the drugs you were still aiding and abetting in the offence for allowing it to take place.

Yes because although you didn't have anything on you its like being an accessory because you were with them and you new what was going on because you were out to party and have a good time.

Guilty bt association - If you were in a brothel and you still had all your clothes on and there was a police raid - you would still get done for being there in the first place - so keep away from drugs and druggies - oh, and keep out of brothels too - your in enough sh*t as it is !!!

You were not an innocent bystander and you had to admit the offence in order to be cautioned. However, I don't think that you need worry about a youthful indiscretion. Even if you thought youw ere going to take some you were lucky that you didnt. but the end deal is is that 1/ you didnt have any on you and 2/ you said that you did not take any! in my opinion i think that you should not have got a caution there is no evidence to even consider giving you a caution. This sods law and is perfetic, just because youw ere with someone who took cocaine does not mean that you should have a caution.

yes simple dont feel for it because u r being caught along with afriend who was drugs naturally it goes to say that you will also be seduced to drugs in course of time if u accompany people who are drug addicts andat times it amy so happen unintentionally and incidentally also that the people who are carrying drugs can as well place them on you so that they can escape safely. always remember that making friendship with antisocial elements is equally a crime and avoid facing such situations in future. ok get urself consoled

I dont see how they could get you done for possesion if it was your friend that was carrying it.

Police cautions dont go on your record as far as im aware, its only if you get convicted!

but if it is, then you'll need to go high up the pecking order in the police station to talk to someone. Admit you were stupid, say that we have all been young and done silly things. Plus if you had nothing on you, then possesion is the wrong term.

It is a bit unfair when you were not in possession of the drug. Why didn't you bring this up in court, or when you were arrested you should have demanded a drugs test to show you were clean. You were actually going to take the coke though so you were in the wrong place at the wrong time with intent to take the drug. Just take your caution on the chin and be a good lad for a while.
Using illegal drugs always carries a risk, and it does look very dodgy 3 guys going into the toilet together all at the same time. Split the coke and go in one at a time to avoid suspicion and always suss out the bouncers in certain establishments..if they look like they are going to be on your case go spend your time and money somewhere else (preferably with no bouncers.)

Wrong place wrong time my a**. You're known by the company you keep and if you hang around with trash like that you will get in trouble. That's just how it works. If you don't want to get in trouble with the law you shouldn't hang around with the type of people who do blow in the toilet and get caught with drugs on them.

Not that it sounds like you've got much of a shot at college, but just so you know if you get drug charges against you you lose all chances at financial aid.

Get your head on straight or you've got a long stretch being your cellmate's girlfriend ahead of you.

EDIT for additional details: I don't think anyone's missed the point. You're locked in a bathroom stall with blow on the toilet seat and one of the guys in there has blow and weed on him. You're lucky that you only got a warning. The fact that you were a stupid kid is not a valid excuse. That's what parents are for and by the time that you are 18 years old you should be perfectly capable of making good decisions; this was not one of them.

it will be a spent conviction anyway and shouldn't effect you in your teaching career as long as your up front you shouldn't have a problem

unfortunately you were in the wrong place at the wrong time, YOU did have the intention of doing things because you said "before I got to take anything" Hopefully it was a lesson learned and you will stay away from that crap and away from those that are into that crap! You are young now but it will ruin your life if you continue. Be smart! If not, the caution was just a wake up call to the reality of **** youre going to go through on the streets and with the cops. I hope you like handcuffs, jails, and rehabs!
