1789 it was made legal by the first amendment. after that it was never illegal, although some people don't understand the first amendment and wish it was. that was how the court got the case in the first place.
btw, you can google it if you don't believe it, but burning a flag is the proper etiquette for getting rid of it if you don't want/need it or can't use it anymore. has always been that way! |

The Supreme Court never legalized flag burning. They have issued opinions saying that it was never illegal, and that it would be against the first amendment to make a law against it.
There have been several cases, but probably the most famous one is Texas v. Johnson in 1990. You can read about it here:

It is not illegal to burn an American flag. The Supreme Court ruled in Texas v. Johnson that flag-burning for free speech reasons cannot be punished. Therefore, it is also legal to burn other flags.

Flag burning, as discpicable a practice as it is, is protected by the 1st Amendment to the United States Constitution. |

Uhm, I'm pretty sure that those who do it defend it through the first amendment (The right to free speech). Which means that it would pertain to the united states constitution (1787).
This right was proven to be true in Texas vs Johnson in 1989 and US vs Eichman in 1990. Trials flag burners won. |

as many have pointed out its not illegal, as a matter of fact that is the proper way to dispose of a flag since it is disrespectful to just throw it away, but there is a proper way to burn and dispose of the flag with honor, which is not the type of flag burning im sure you are referring to, which is very disrespectful and the ones that do it are the same ones that spit on our soldiers and bad mouth them after those same soldiers have defended their right to do so |
