When pressing charges, how far should I go?

Today at school my son was talking to a friend during PE. Another student came up from behind him and stabbed him in the chest (mid chest to the right of the sternum) with and ink pen. There is a small puncture wound along with some swelling. The school did tell me that I have every leagl right to press charges. My question is, is this battery or attempted murder or what? I will be going to the police station in a few hours when my husband gets home from work. Any advice?

I would imagine it could be deemed attempted murder based on the fact that he was stabbed in the middle of the chest. But as soon as you have pressed charges it is out of your hands, then the DA could make a deal with the boys family. He might end up serving some time in a detention center, or a boot camp, or something else along those lines. He might not even end up serving any time at all (of course he or his parents will be responsible for any doctors bills). If something like that happend to either one of my kids I would press charges and follow through with them, for the main fact that someone knows what they are doing if they come from behind and stab someone in the chest. I hope that other kid gets put away for awhile because he needs to think about what he did and maybe learn a thing or two about kids that really don't give a crap. I thought I was one of those types until I went to JDC and learned that there were other kids that really didn't care what happend to them as long as they messed up someone else in the process. Definitely follow through on pressing charges! |

Nail the little ba$tard to the wall for assault. The police will be better sources for information as to what you can charge that little delinquent with. More parents need to make examples out of these heathens. Maybe then the parents of these brats will rethink the way they are raising them. |

it depends on how old the student who stabbed him was, but if it was a serious situation, i'd say attempted murder.
if you feel it might be pushing it to charge for murder attempt, which it very well may be, i'd go for battery. |

That is assault. You have to press charges. Your child was lucky it was a pen and not a pair of scissors. If you don't press charges, this kid will do it again, to your son or to somebody's else child. Don't wait until your husband gets home from work; call him to let him know you are the way to the precinct and tell him what happened. |

Give the police all of the info and ask them. They will have a better idea. Or get a lawyer and quiz them. |

Sounds like battery. But you also have a cause of action in civil court for any damages, like hospital bills and such. You should check that out. |

It's certainly battery- whether it's attempted murder or not will depend on whether the other boy was attempting to kill your son (probably not). In any event, all you need to do is explain what happened and whether or not you want to cooperate in prosecuting the boy- from that point it will be up to the police and the DA to figure out what charges should be brought, if any.
