Find answers to your legal question.

When will it be ok to sue a woman co-worker for harassment?

I've had situations in the past where I was treated poorly by women. I was harassed by a co-worker on two occasions, but was not able to get any support from HR because I'm a white male. recently I was fired from a job and defamed by a co-worker who used her position of power to write un-true and damaging emails about me. I have written documentation and nothing to do with it because it's historically men who harass women when in some cases its just harassment regardless of gender. I know I can not get damages , but just beg the question ... IS THERE GOING TO BE A TiME WHEN MEN ARE THE MINORITY or equality in the work place will protect a White Male as well from Tortious complaints and defaming statements ?

Men CAN sue a woman co-worker for harassment. If you have written documentation you will win the law suit.

So this happens all the time. If you believe you are harrassed you should first contact your HR department. If they do not help, then you can contact your state employment office and file a complaint.

When you file a complaint with your state, they will investigate the situation.

If you get a judgement from your state employment office then you can file for damages.

Are there any witnesses to your harassment? Do you have evidence? If so, contact a lawyer.

Don't expect anything from HR. When you complain it means that, to them, you and your possible lawsuit are a threat to the company. They won;t be any help. You have to pursue it on your own.

Are you truly wronged or do you just feel like you are? If you have the documentation, why don't you take it to court. Of is it just her word against yours? I know a white male who has won such a case. I also know women who have been harassed and there was nothing they could do about it but quit. It is not only about documentation and other evidence, it is about how you were wronged and if that caused you financial hardship. If your evidence is weak, no one is going to want to help you prosecute. And you may want to evaluate if it is worth your while to go through the hassle and pain of a trial.

Being taken seriously for harrassment issues does not depend upon your being some type of minority. What it depends upon is your having a legitimate claim. Are you interested more in resolving this present issue, or more in forgetting the present issue and just using your experience to generally vent about the unfairness of the world? Welcome to the experience women have had for centuries. Now if you have a case I hope you make it and find justice. BUt workplace situations can be political, and often it isn't justice that prevails, but whoever has the power on their side.

You were not unable to get help from HR because you are a white male. You perhaps did not get the action you desired because the HR person after investigating, saw your claim was without merit. Now you have been fired because someone defamed you by email? Nothing personal but did it ever cross your mind that you do a lot of scapegoating? has it ever been your fault? why is it that white men in jobs ,high professionals to wallymart seem to be doing good if the company is doing good,
By the way there are lots of women who are upset because they make less money than a man doing the same job, and have no way to get any type of legal recourse.
I discussed this with my husband who is a supervisor who has to deal with these types of issues. Because I wanted to be objective.
White males have held the status quo of business since the start of the country. What I think you should do is start your own business where you answer to no one or try and learn what it is that keeps you with more times of being harassed and fired . Sometime self examination is the greatest reward we can give ourselves and others. best of luck to you either way you decide to go.
Hey angelus: I have worked hard and after completing an MSW and a Juris Doctorate degree I chose to do family adoptions and I hire my own staff. One weekend they knew I was going to paint my office but got a cold. I came in on Monday and they had painted and redid my office with their own money. It was very touching and guess what I work with 5 white men and 3 white women. All have been with me for 12 yrs. please dont put all people in one basket. because as a minority I know what it is like and would never abuse my power nor be a b*&ch to anyone. That is what the courtroom is for not for those that depend on me to keep a business successful for them and their families. I guess some people need to get out more and maybe be open to meeting people unlike themselve so that they don't judge the world by their contact with one person.
oh and I also provide health insurance to my employees and a day off on days when their kids have school events.

C'est Manda!

My friend, welcome to Women's Lib. Where women are more equal than men, and most ethnicities are more equal than caucasians. Being politically correct only means offending non-caucasian males, or didn't you know?

Edit: Interesting you bring that up, Manda. Women are raped far more, per capita, in the civilian sector than in the military. In the military, we see them as part of the team.

Maybe HR doesn't want to listen to you, but they will listen to your lawyer. Most towns have a referral service and lots of lawyers will give you 30 minutes free to state your case and decide if they want to represent you. Go for it!!

I'm sorry this happened to you. This is the effect of feminism ladies! You make men miserable! I feel for the white male, they really do have it the hardest in the work place.

no women can get away with almost anything, when are you going to learn?

Bring a video camera around and hide it somewhere to record the harassment, or a tape recorder in a pocket or something if it is verbal. That should be enough evidence to prove your case.
