I recently left a job in a large company because they illegally made all employees work for 8-10 hours without so much as a 5 minute break. All employees are entitled to a 15 minute break every 4 hours. The staff were always exhausted and cranky, I feel that they were unaware of this law and I might be doing them a favour by reporting the situation. Plus, the managers were all nasty types and I'm feeling just a wee bit vengeful for being mistreated!

You go the your local labor department. It is usually a State Agency like
Florida Department of Labor. They will handle all complaints and issues. |

However, if you had been in the job for a sufficiently long period, you might be able to complain that you had been constructively dismissed and bring an action for unfair dismissal, as you say that it was their draconian behaviour which made you leave. As "Timbo is here" and Jellybean say, the HSE is the place to start if you want to report them.
However, based on what you have said I think you probably have a case for taking them to court personally, certainly for breach of the Working Time Regs, and possibly for unfair / constructive dismissal and / or victimisation.
I suggest you find a local solicitor specialising in employment law and go for a chat. You should have no difficulty in finding one who will give you a free initial consultation, and then you will know where you stand.
(This is based on knowledge of English law by the way, but I doubt Scots law will be radically different on these points.) |
