Regardless of which states have legalized marijuana, the federal government still has laws on the books declaring it illegal. When state and federal laws do not agree, the federal law ALWAYS take precedence. So, there is no legalized marijuana anywhere that the federal government has jurisdiction.

have all decriminalized, as in you won't get a heavy penalty for having a small amount perhaps, even left off. How ever its is still illegal to have it.
unless use for medicinal purposes.

I am not sure how many have legalized it however I have a theory of my own. I know that many have been pushing for the legalization of marijuana or the use there of for medical purposes.

Just a thought but if it were to be used for medical purposes then there should be some knowledge of its use. The prescribing physician should know enough about that which he is prescribing to determine the THC level for the particular ailment he or she is prescribing the so called medication.

Thus if one who is in possession without a prescription is caught, this one time substance that had previously been a misdemeanor now being a controlled substance. The abuser should be busted for possession of a controlled substance which is a felony.

Those who are trying to make it a free ride to use marijuana could just be making the possession more severe. The crime would then no longer be a misdemeanor but is now a felony thus the punishment must also be more severe.
