Someone Hit my car and jetted.
1) If they're never found by the cops, who do I sue
2) If they're uninsured, who do I sue? Additional Details *might be confusing: i meant someone wrecked into my car

If the person who hit your car is never found, there is no one to sue.
If the person who hit your car is uninsured, your insurance will cover the damage to the car (you may need to pay a deductible). Your insurance company will try to collect, but that doesn't always work.
If you weren't injured, you don't have much reason to sue. |

You need to find the person first. If not, your insurance MAY cover the damage if you have the proper coverage. Otherwise, you are out of luck. |

You would sue the person who fled the scene in both cases. They are held responsible regardless of Insured or Uninsured.

The cops have to find the person who hit you... otherwise, who else can you sue? Dept of transportation for making the roads? Cops for not finding them?
Sorry... the guy who hit you is responsible, whether he has insurance or not.
Go to your insurance agent... your insurance should cover it and will look to find the guy cuz THEY want to get paid. |

That is what auto insurance is for. Good luck finding who did it. Uninsured driver coverage and other unpleasant things like this are often covered. Check with your agent. |

If you didnt catch their license plate number and you dont know who the heck they are..the best you CAN do is describe the vehicle to the police, and if you kind of saw the person inside, describe them too. But uhm if you cant remember either of those their is really nothing you can do so you cant sue. |

You can not sue. That is what you have insurance for. Your premiums go up no matter who is at fault |

Your insurance company will take care of all this, provided you bought "uninsured motorist" coverage. If you didn't, then you're out of luck and need to buy some ASAP so this doesn't happen again. |

Well if they aren't found you can't sue anybody, you will have to handle the repairs with your own insurance company that is why you usually have "uninsured motorist insurance" just for that.
If they are uninsured you can only sue the person who hit you, the problem is with that if they don't have any assets (house, money, etc) to go after then you're screwed and aren't going to get anything by suing them. |

Unfortunately, if the cops don't find them you are pretty much out of luck.
But if they do find the guy, you are in business. Insured or not, he broke the law, damaged your property, and is liable for that. If insured, you can go after both him and his insurance company. If he isn't insured, you can still sue him personally, adding in the fact that not having insurance is also against the law. Be sure to press charges for the hit and run if he is caught.
Anyway, that's to the best of my knowledge. I'm no lawyer or anything, but I think this is correct. |

No one if the person who damaged your car is not found. You'll have to just pay the damage yourself if your insurance won't cover it.
If they are found and they are uninsured then take them to small claims court to make them pay. The court will decide on the method of payment based on income, lump sum or paycheck garnishment. |
