Who is to blame here, the plaintiff or the lawyer?

If a man tries to sue a rocking chair company because he tried to use the rocking chair as a stool and fell, should he be the one to blame and called stupid or the lawyer who took the case? I'm just mad at a lot of stupid lawsuits that have no justification behind them, it's just dumb people doing dumb stuff.

The man who used the chair for an unintended purpose assumed the risk when he stood on the chair, so I guess that's pretty stupid. Some lawyers will take anything that comes in the door, hoping to win. Unfortunately, these lawyers don't have the balls or intelligence to counsel and advise clients to drop the idea of suing, when it was they who made the mistake (or did the stupid thing). The man should have asked the lawyer, before hiring him, how many times he had to take the Ethics section of the BAR exam, before he passed!

A lawyer is legally liable to represent the client, and can only be liable for incompetence or misrepresentation. In an adversarial system {unfortunately} the judge, lawyers and jury are not liable.

Isn't this country lovely? I used to work in a prison and we had signs on a hill near the perimeter fence that plainly read, "Don Not Approach Fence." One idiot climbed up there anyway, fell down the hill, sued the state and won. Few months later, same inmate fell out of bed, sued the state and won.

People just want money and they think by suing people they can easily get more because they don't really have to do anything. I think it is the person, not the lawyer who is to blame, the lawyer is just doing his job.

It's all about tort reform. Sounds like another stupid, probably baseless lawsuit. The lawyer sees a chance to make money and agreed to take the case.

People are suffering financially and will do this to get money -- it's a big problem. It affect insurance rates, everything. A lot of cases settle before they go to court and the insurance company may pay an amount just to shut the plaintiff up and not to pay for all the attorneys fees for a trial. It's all about greed.

In this situation, both. The court will decide in favor of the defendant and the plaintiff will have to pay court costs.

I would have to say, the judge who ruled in favor of the plaintifff is the stupid opne. Or, if it went to a jury, then the jurors had to be paid off by the plaintiff and the lawyer.

They both are to blame, people shouldn't be that stupid, and the lawyer should have some ethics, and tell the idiot that stood on the rocker to get a life.

Most of the time you only 'think' the lawsuit is stupid because that is what big business wants you to think. They are manipulating you by only giving you half of the story.

IE, years ago a woman won a lawsuit against Mcdonalds for getting burned by hot coffee. What most ppl didn't know in the public was that Mcdonalds had been repeatedly asked to lower the degree. Also, the woman was so severely burned that she spent 3 days in the hospital and had to have skin replacements. What if that coffee had turned over on a small child's face...

IE, fast food restaurants are being sued for fat content... seem silly? What you aren't being told is these restaurants are actually adding extra fat to their french fry oils, buns, etc.... So when you go eat a big mac and you know it is fattening, what you don't know is that it is about 5 times the 'reasonable assumption' of how fattenting. Also, these fast food restaurants were given then option to just post the calorie and fat content on the menu for each item but they said no.

See? You just think they are stupid things because you are not being informed of all the facts.

i guess both but then again the lawyer is just trying to get some cash so i wouldn't look at him that stupid but he's stupid but at least he's getting money out of it

The guy who bought the rocker and the lawyer. This is how the system got the way it is today! STUPIDITY!! We are a country of enabling stupid people. And always something for nothing! Didn't it kinda start with spilling hot coffee? Of course it was hot!! DDUUURRR
