Why did the Army stop paying my husband his medial retirment pay?

My husband is 21 yrs old and was seriously wounded while over seas, to the point of being medicaly retired. The Army rated him a 60% disability and the VA rated him a 90% disability. Up to two months ago we noticed that the Army retirement funds have not gone into our banking account and we are in a panic. No one has given us an answer as to why this has happened.

If you have any clue what is going on or have gone through the same thing, please let me know and give me an idea on whats going on :(

The Army retirement pay is offset by any VA disability pay your husband is receiving. So, for example, if the 60% entitles your husband to $1200 per month, and the VA disability is $900 per month, then your husband will receive the $900 from VA, and $300 from Army DFAS.

If VA disability is greater than the Army disability pay, then your husband will receive only VA pay.

If your husband's 60% disability pay is larger than the VA 90% disabiity pay, then you need to contact DFAS, or the Army Disability Command (if your husband is on the temporary disability retirement list) to see what the problem is. A possibility is that your husband did not show up for a physical. Soldiers on TDRL are required to undergo periodic examinations to determine if their disabling condition has improved. Failure to show will result in payments being temporarily terminated. Now, the Army will notify the soldier when an examination is scheduled, but the Army will send notice only to the last known address. It is common for soldiers to move without filing a change of address with the Army. Perhaps that's what happened???

The VA has people who are supposed to help with that... don't take "no answer" for an answer. Contact your Congressperson and keep calling back. Hopefully it's just a paperwork error. If you can't get it resolved, contact your local newspaper, and probably an attorney.

He's not retired from the Army at the age of 21; he was medically discharged from the Army with a disability. The Army doesn't pay disability income. He is disabled and since he is no longer entitled to monetary benefits from the Army, he will receive his benefits from the VA.

Get the name of EVERY individual, their function and sue ALL of them as INDIVIDUALS. From his CO to his dotors to the VA secretaries.

I know this works because I did it for my son who the VA literally butchered in surgeries.

Do NOT let them rest. Call your local senator, state rep and bug the hell out of them. Make it public.

I called Senator McCain every day, every 3 hours for 2 weeks.

Do NOT give up. We the people can not allow them to use our soldiers as canon fodder to further their own slimy agendas, then not care fro them after they made a sacrifice.
