Why do some juveniles get prosecuted as adults, is that legal?

For example the 15 year old Somali pirate that was captured is going to get tried as an adult. What determines if someone will be tried as a child or adult?

well my question is asking what those standards are. What determines if a 15 year old gets tried as an adult?

It's to do with the serious nature of the offence. I think for some offences they decide they are so serious that the age doesn't matter, if you do it you should be judged the same as everybody else. I think for some offences it's either mandatory or discretionary (not sure which but you could look it up) and the judge decides whether the age should be considered or not.

It's not the case in all jurisdictions, so it does depend. I don't think we do it here in Australia, but I know some places in the USA does. Personally I'm not in favour of it.

It depends on the severity of the crime and the jurisdiction that the person will be tried in.

I say that he shouldn't be our system. He is going to stay in an American jail and let the tax payers give him free health care, food, and shelter. Compared to the hole we dug him out of, he is going to live like a king.

Obviously its legal in some instances for juveniles to be prosecuted as adults. Whether or not this SHOULD be legal is a matter of public policy. Different states have different standards.

You have it backwards. Everyone, of every age, is ultimately responsible for their actions. Some legal systems give special treatment to young brats. There is no innate reason they should.

You haven't used a very good case for your example..... the somali pirate we have in custody is not 15 and there is evidence that he is in fact 18. Without any evidence to prove otherwise we are just guessing though.

Several factors are considered, most of all the severity of the crime committed. Often rapists and murderers are tried as adults.

A second factor would be how close to 18 someone is ... for example someone that is 17 is more likely to be tried as an adult then someone that is 16.

All in all, the captured pirate has gotten off lightly regardless of what happens, the other pirates he was with are all dead and he is most likely going to be given a jail sentence.
