The language and the history of the amendment show that it does not. Why did the courts ignore all this evidence? Additional Details Why leave out the phrase "and subject to the jurisdiction thereof?" That has meaning!

The phrase "and subject to the jurisdiction thereof" means anyone who is subject to US law. If you say that illegal immigrants are not subject to the jurisdiction of the US, you are basically giving them immunity from prosecution. Is that what you want? |

The first sentence to the Amendment makes it clear who is a citizen and it does give "birthright citizenship."
It should be changed to give birthright citizenship only those born in the U.S. who have at least one parent who is a citizen or legal resident. |

Maybe because it very clearly states:
"ALL persons BORN or naturalized in the United States ... ARE citizens of the United States."
To most people, lawyers and judges, this is quite clear. Sorry you can't see the obviousness.
The Amendment doesn't make any historic reference (even though a post Civil War amendment to ensure slaves are citizens) or define future parameters. |
