Largely because the questions are poorly written. The law is a fact driven beast - a minor change in the facts can have a tremendous impact on the end result. Most laypersons don't fully understand this and tend to gloss over or leave out important information. Therefore, its better to err on the side of doom & gloom than sunshine & rainbows.
