It has now been 18 months since child is with me full time, he gets supervised visits. He & his attorney have filed continuances a couple times on the hearing & may do it again. I have spoke with my case worker at the enforcement agency & she had said there's no need for me to hire an attorney since the agency has their own on my case. Is it possible for a parent to NOT be obligated to pay support? What is the point of contesting since all it seems to do is delay the payments & add up the arrears. How long will he have before payments have to be made before it is enforced by the agency? I honestly don't expect to see a dime ever as I believe the delay is due to a pending criminal trial which once he's incarcerated will be a mandatory $50.00 order if I'm correct. But won't the arrears still be owed, etc.?

Some people are immature and just want to annoy their ex even if the child suffers. Others don't really care about their kids. Others care more about money than anything else. And others have this terrible sense of being wronged and just want to fix it because they are really annoying and don't think they shoud pay.
I'm not sure what would happen, but unless there's an error in how it was calculated or something else he has to go on, I doubt his contest would be very successful. I don't know how long they wait to enforce things.

ok from what i know of. if he doesnt pay child support for months and it keeps adding up it will double on him and eventually things get worse.if he is ignoring it it is illegal but if he is getting letters and he doesnt know of it there cant be charges against him. |

You answered your own question. You said it was because of a pending criminal case. Really, it is his right to contest child support and if you live in a state where they will order $50 a month for someone who is incarcerated, more power to you. In CA, when people are incarcerated, that's an automatic zero child support order since there are no jobs behind bars to pay. |
