I currently work at Company A as a LPN taking care of a client and I signed a home care worker service agreement stating that i'm not supposed to work with this client if they switch company's. The family did switch company's but they still want me to work with them. Can company A sue me if I switch?

Yes. If you violate the terms of the contract, you can be sued. Seems like this situation is precisely what the contract provision was intended to address. |

In some states, any such contract provision is unenforceable.
Even if the provision is enforceable, it will be a breach of contract cause of action. A party may recover only the amount they're out as a result of the breach. That means Company A will need to prove that Company A suffered a loss as a result of your continuing to work for this client. I'm not sure how they can demonstrate any loss; the client is no longer with company A, so how does it make any difference to Company A's finances or revenue whether you continue to care for this client or not??? |
