I started filing bankruptcy a couple of month's ago. My mom passed away & I'm supposed to receive a life insurance policy. I asked my lawyer if the court could take that money from me, since it was life insurance. She said it was considered an asset of mine & if we went ahead & filed, it would depend on who the trustee was that I got, whether or not they would take it from me. But she said they could take it. But then she said if I were to spend the money before they filed, they couldn't do anything. So she advised that I hold off on filing it & wait till I get the check. But she also said I would have to tell the judge what I spend the money on. That it couldn't be anything like paying back a family member, because that would be seen as hiding assets. So I'm wondering if they are going to want to see PROOF of EVERYTHING I spent the money on or just my word, telling them what I spend it on. Thanks...

Why not use the money to pay back those you owe money to instead of filing for bankruptcy. That would be the right thing to do.
The judge will want to know what you spent the money on and why you didn't pay off your debts with it. |

Pay your bills. Can't have it both ways, and the judge will make you prove it. Guaranteed. |

use most of it to pay your bills and the judge will want proof just dont use it all because if you are still going to file after that you just threw money in the toilet but at least you had proof |
