Would a child be taken into care if solicitors found out the parent smoked weed every day?

My boyfriend is taking his ex to court at the moment to get visitation rights to their son.

She is pulling every reason out of the bag to not allow him to see the child unless supervised. (Her reasons really are shockingly minor- 'he gives him fizzy drinks' and 'lets him stay up til 9pm')

In his defence, my boyfriend is considering telling the solicitors that his ex smokes weed. She smokes it every night when the child goes to sleep and spends over £150 per week on pot. He has no worry that she would harm the child or allow him to be harmed so doesnt want him to leave his mother, if he told the solicitors she smokes weed would they remove the child from her care??

Like I said my boyfriend is happy for the child to live there and isnt worried for his welfare, he doesnt want and cant have the child living with him anyway due to certain other commitments.

If she's using at that level, I would be very worried about the child's welfare, both through inhalation of the smoke and because she doesn't seem to be able to give him the care and attention he needs. How old is he?

The fact that your boyfriend isn't worried about that also concerns me.

Remember, whatever petty arguments your bf might have with his ex, the person who matters in this is the child, and it might be that the best thing for him may well be to be looked after by someone else entirely.

The solicitors have no power over the child's welfare, but if it comes out in court that the mother is a drug addict (as you'd have to be to spend all that money on pot), social services will pick it up and place the child on the at risk register and there's no knowing where it will all end. Where does she get all that money from? One has to wonder. Perhaps there are other things going on which she wouldn't want the court to know about.

This child might be better off in care.

If the parent is smoking weed every day and smoking THAT amount of weed, then there the high likelihood that the child is passive-inhaling the smoke, which would of course be harmful. There may be other issues, ie if she gets stoned whilst her child is asleep she may be unresponsible or unable to rouse herself to tend to him should there be an emergency or should he be unwell etc. Plus spending £150 a week on pot may leave her short of money for essentials like healthy food and clothing for her children - if the child was found to be going without any of these things because of his mother's pot use then yes there is a chance the child would be placed on the "at risk" register, although being taken ito care isn't usually a snap decision, the parent would be given the chance to work through their issues/addictions and argue their case in court.

It sounds to me that she shouldnt be looking after a child if she puts her own drug use to the forefront in such a way. Thats £150 she could be spending on her kid. I would also be very worried about her getting that stoned when she is supposed to be in charge of a child. What happens if she falls asleep and drops a spliff on the carpet? House goes up in flames? What happens if the child is ill or needs her in the night and she's too out of it to respond to him. Horrifying.

Parents who use drugs are unutterably selfish.
