Would "Joe" win in court?

I got a Parrot from someone on a payment plan lets call this person Joe. Before finishing off paying Joe for the bird I decide to give it back to the original breeder. There was no contract signed or written for this payment plan. The breeder has not given me money like they were suppose to- so I have not paid Joe back. Joe is upset and says he will take me to court. I don't think he'd have a chance as there was no documentation at all for this arrangement. I've lost what money I paid into the bird and Joe has lost his?? What is your opinion.?

Joe was not suppose to sell the bird to begin with- not that it has anything to do with the question. He was suppose to return it to the breeder if he could not keep it.

He wins. You agreed to pay him money for the bird. The fact that someone else owes you money for the resale of the bird is irrelevant to the original (verbal) contract.

Yes if u lie in court and say u only agreed to what you already paid joe, then u would have a 50-50 chance to win. But you agreed to a certain price and accepted the bird. It is not joes fault u decided to give it back to the breeder so the judge would make u finish paying joe, and you would be out of whatever agreement u had with the breeder. Example: I sell u a car for $500. You accept verbal agreement to pay me $500 then in a short time later u sell car for $500.00 to someone else. Lets say the person you sold it to did not pay u. U would still owe me the $500 even if you took a loss, because that is not my fault you sold the car and took the loss. You would still owe me agreed upon price and you not getting paid is your problem not mine. If you sold the bird to joe and he pulled this crap with you, wouldn't u be pissed? So u got screwed, thats not Joe's fault, it's yours.

There's a thing called express contract and verbal contract. If you both knew the terms of the agreement, regardless of it's form (written, verbal), you were both under the impression you did this and he did this.

You were obligated to return the parrot to "Joe," that's where you got it. Why would you return it to anyone else?

It seems you are too irresponsible to be dealing. You need to get written and signed transaction records. You can't just act on whim. You need to think about what you are doing.
