you shouldn't ask a legal question like this, without specifying what jurisdiction you are in, whether you are referring to rape or statutory rape, and you certainlyh shouldn't be asking anonymous nonlawyers on the internet their opinions. You will get nothing but semi-educated opinions and will likely have at least a half dozen different answers.

If you really need to know, have an actual lawyer write you an opinion letter, citing to the laws which support his or her conclusion.

It is actually a crime to give legal advice without being a lawyer in most jurisdictions. So, you should definitely not rely on such info from unknown questionable sources.

Yes. The law declared that the woman doesn't have to say no when she is in a state of fear.
Will you win the battle in court that is a different story.
Also, if you did decide to pursue action you have to make sure you haven't passed time limitations for charging him with rape

It sounds serious enough to at least be assault. I'm not really familiar with laws and definitions of all these different types of breaking the law, but it sounds like you were scared to say no to him because he may have hurt you. Were you able to get out of the relationship? Do you see him anymore?
Anyway, it's probably a good idea to not bring up those memories even more by pressing charges. I hope everything goes well for you, and that you're able to talk with your experiences with others not only to help yourself, but to help others.

I think it would be considered rape. Most rape laws don't say that it's rape if the victim fails to object--instead, they say it's rape if the victim fails to give consent.

It doesn't sound like you were given the opportunity to give consent. In fact, you were too young to give consent.

The fact you have bad memories suggests that you might be even be questioning yourself in terms of what you failed to do, which is something that you shouldn't do--doubting or blaming yourself.

I suggest that you call a hotline (link for research below) and talk to them about it. These counselors are very experienced in dealing with these questions. No matter what you decide to do after that, it may help ease your mind to talk to someone personally who can assure you that you were not responsible for this.

Depends on what state you were in. In some states, the fact that he was 18 and you were underage makes it statutory rape. Other than that, if you didn't protest, I don't believe it would be considered rape.

My friend...it is called 'statutory rape' and since it happened within the last 3 years, he can be charged. You need to consult an attorney asap.
