You’ve just bought a cup of hot coffee in McDonalds. As you get back to the seat, you trip over the bag you'd left on the floor. The coffee flies right over the person next to you, they’re unhurt but drenched; worse still, they were there using the wireless internet on a laptop. The laptop's soaked, the screen flickers and dies and the computer is now kaput. Neither of you are insured. What would you do?

Both parties could exchange phone numbers and the owner could get a quote for a repair. It would be fair to split the cost of the repair. If it cannot be repaired, then the owner is out of luck. A friend recently dropped his cell phone while at work (he was washing dishes at a deli). Should the caller be responsible?

insurance has nothing to do with it. you have a duty of care, in law, to others. Clearly in this case you were negligent. The "wronged" person can sue you and would win.100%. Often an apology is enough depends on the damage you caused. I would offer to put right the damages. Imagine if it was the other way round. |

I would talk to them about where we should go from here. Of course they would like to get their laptop fixed, but perhaps they would not want you to have to purchase a completely new one, as after all, this was an accident.
Just like accidents with cars, since neither person has insurance, it is really up to the two people to compromise and find a solution. I would only pay if that's what's decided and agreed upon by both parties, and if it seemed fair in that situation.
By the way, that happened to a friend of mine (his got spilled on/ruined at a coffeeshop) and the person apologized...he took it in to get fixed thinking it would be ok and is wasn't...but he hadn't gotten their contact info so he was screwed. Always at least get their info in thiese types situations. |

Your talking about a new 'Compensation Society' that we live in today. First of all , would you leave a bag unattended?
Secondly , the coffee would be very hot , so there would be an injury. Your hypothetical question is full of holes.
I did have to recompense someone about 5 years ago , I used the wrong implament to clean out a fridge-freezer and it went through the piping and al the gas escaped..... this cost me £350 for a brand new one , as it wasn't seen as an accident but incompetence on my part. |

What is the idiot doing using his computer in a eatery? There are just too many pretentious people phoning and computing on the move. There is a place for everything, and a eatery is not a place for using a laptop. It is for eating. Tell the idiot to go home, wash the laptop under the tap and let it dry out for 40 days before switching it on. And, next time keep it at home or the office. |

I don't know if I would pay for it because you should never drink or have fluids near a computer. This person was using her laptop in a place where beverages are on sale. He/she was an accident waiting to happen. Maybe McDonald's are covered for this type of mishap. |
