a person I know got into some small time trouble in a tiny town in Missouri.?

when he went to court he asked for a public defender and was denied and told to get his own attorney. I know nothing about the law as I have never been in trouble but have always heard the words "if you cant afford an attorney one will be appointed for you" any in site to the truth would be helpful. thank you

that does help, thank you. this 21 year old does not even have a car. the reason he is in trouble is he was just hanging around local store hoping a farmer would put him to work and got into a fight with other young men trying to do the same. the small town police singled him out as he has only lived here a short time. the others looked at it as one less to compete for work.

Courts do not appoint representation for most infraction or misdemeanor cases. If your friend is charged with a felony, the court should have been able to determine his eligibility for a public defender. If he is charged with simple assault (or common assault, whatever they call it where this happened) the charge is not a felony and the court will not appoint defense.

a person would have to show they could not afford a lawyer, they just can't ask and get one..

The key words are "if you can't afford an attorney". Your friend might own a home or have other assets he could sell to pay a lawyer.

The definition of 'cannot afford' is not a simple one. Because he didn't WANT to pay does not mean he cannot. You are expected to defend yourself to the extent of your income and assets. You can't drive around and in nice car and claim "I can't afford an attorney". You have to qualify.
