could I get custody of my sister?

I'm 18 married, no kids, have my own place and work in the ER. My mom is an abusive mother and my sister's dad (was my step dad) is a great dad but does have some anger problems also. I'm going to court with them since there both trying to get full custody. I'm going to testify and say what my mom used to do to me and my sister and why i feel that neither parent is capable of having a steady relationship. could i try and get custody of my 6 year old sister? I live in Austin Texas. Or could i at least get visitation rights?

The court system always do what's in the best interest of the child. If the judge sees that living with you is better for her than living with your parents; then he/she will award you temporary custody for about 60 to 90 days. After that, you will have to go back to court for a progress report. If all goes well, you might gain permanent custody. It will also depend how well the natural parents are doing as well.
Loophole: By law, parents are required to provide food, shelter,clothes, and make sure the child gets shots and an education.

You don't have a realistic hope of getting custody when there are two biological parents who are fighting for custody of the same child - unless perhaps both parents have extensive criminal records and have established drug/alcohol problems.

If you believe that your stepfather is a "great dad" but has some anger problems, then you can say this. Perhaps the court will order parenting classes and/or anger management classes.

If you torpedo both of your sister's parents in court, you will almost certainly alienate both parents. The parents of a child are the gatekeepers - this means that if they don't agree to let you see your sister you are not going to see your sister. If you want to pick a side - then pick one parent. If you think your stepfather could benefit from an anger management class, go to him and tell him that you think he's a great father and you are planning to testify to that effect but you would encourage him to enroll in this class to make the judge look more sympathetically on him.

I would strongly recommend that you remove the expression "I feel" from your vocabulary with regard to this custody battle. Honestly, your feelings and your conclusions are irrelevant and not especially helpful to the judge. You should stick to the hard, cold, verifiable facts. Describing your mother as "an abusive mother" is a conclusion - not a fact. You should be prepared to provide dates, times, and a brief description of specific RECENT behaviors that you have witnessed. (Things that happened 10 years ago or even 5 years ago are not especially relevant - unless they are extreme. You should try to focus on events of the last year to eighteen months.)

Your parents would keep you from your sister? Are you capable of providing her with a good home? Clothing, feeding her, raising her, educating her, etc. That's a big responsibility.

If you want custody, and I mean want custody, you would need to hire and attorney and fight for it. If you testify with what you just said...more then likely your testimony becomes a draw for both parents or he will pick the lesser of 2 evils. If is really is unsafe and you haven't said why or examples, have they been reported to the police? Do you have pictures of abuse? Then more then likely you will not get custody. I am not a lawyer, and I would suggest consulting with one. Consultations are usually free, but ask and make sure. Find out their fees, the process, etc.
