My grandfather had 5 children, 4 female and a male. Also he had properties in Kerala which he ot from his father.My father is 4th child to my grandpa and he died in 1973 and at that time out of 5 children and last daughter got married after 1973.
In 1989-90 my father ha sold almost all properties (including in self aquired property (Geni) which he got on LRT judgement), believing that his sister are not having any rights and bought a new property in Karnataka and registed in his name. Also my father has produced a AC court judgement copy saying he was a farmer in Kerala ( By producing only his LRT judgement property documents)
Later, my dads 3nd sister (Married in 1964) got expired in 2009. And now her daughter and husband had filed a legal suit claiming that they are having rights(which is passed on them on my fathers sisters death) on the property which my father is enjoying in Karnataka. Also the worst part is that my dad has trusted evrybody and never maintained any records for doing payments to his sisters. And dad 2 elder sisters are with my DAD and rest 2 are against him.
Here claiments family is well settled with our support and they dont remeber and we dont have any proof for the payments done to them my my grandather and my father. Also in our difficult times (we didn't have money for food in 89,90, till 93) and nobody was bothered to help us and with great difficulties we have made good progress and settled good) And now everbody is behind our properties.
When we contacted on of the advocate he says that there are chances of loosing the suit and property may be devided among all children of my grand father, bacause my father has aquired the property in Karnataka by selling ancestors property.
My full family is depressed and down because of our efforts may go in vain, Sad thing is that, We have independence, But our law is blind and our legal system doesnot safeguard the innosent people.
Now also my dad believe that as the ancestors roperty is sold much before the LAW ammendment which happened in 1993, his sisters will not get any right on property, and secondary the new property is self aquired property and nobody will get the rights on the property.
