I had a generator and zaw-zaw stolen. i know who didi it and he admitted it. now hw had 1 day to give 260.00 the value of the property. He only gave me 70.00 and i took it. Can i still press charges?

yup, for theft or take the easy way, record him admitting to the theft and steal your stuff back it's not really stealing though since its your own stuff |

You can certainly try to press charges, but it will be hard to prove he stole the property based only on your word that "I know it" and "he admitted it to me." He will probably deny it and then where is your proof?
Furthermore, now that money has changed hands, he can claim that you sold him the property for $70. Then it would just become a duspute over the sale price or the collection of a partial payment (not a criminal matter). Basically, if you get the police involved and you admit that you accepted money, they may drop the matter at that point. After all, who negotiates with and accepts money from a thief? It's not a simple case of theft.
I think your most practical course of action is to gather up any proof you have of ownership such as sales receipts, owners manuals, serial numbers, etc. If you know exactly where the property is located, you can ask the police to recover the property for you and they might if they are convinced that you own that specific property. Do not admit to accepting the money. If he claims he paid you, ask to see HIS receipt. If you get the property back, return the money the next day. |
