this dumb guy keeps coming up to my windows and taking pictures of me!?

for the past 4 days this guy has been walking up to my window when i'm in my house and taking pictures of me. he has also been doing it to my neighbors. The police are aware about him but every time someone calls them he is already gone. (there is a creek by my house he runs into and hides) So if he does it again can i throw an orange smoke grenade at him so he cant see anything followed by some tear gas and maybe load my Taurus with blank round, come outside with a gas mask and shoot at him to scare him the crap away? or will i face charges if i do so?
