5 year Background Check to work in aviation industry?

Can anyone point tme to the relevant regulations which state employers in the Air/ Air Transport/ Air Freight Industries have to ensure that background checks of 5 years must be conducted on all prospective employees? (FYI, Company in UK)

A lot of aviation industry is located in california.
If you apply for work in California, here is a detailed description of what a California background check can and cannot do.
It covers things like rap sheet, arrest record, ect.

For example, in California the background check cannot include arrest records, unless it was followed by a conviction. California companies cannot check your medical records unless they have already made you a job offer.

The point is that each state and country have a lot of peculiar differences in their laws. So for the UK, you would do well to research the UK privacy and background check laws.

In the UK, criminal background checks are done through the Criminal Records Bureau. But sometimes that misses criminal information, even about child molesters, as was shown in the Soham trial, in 2003.

Here is a typical list of pre-employment information gathered by a big company in the UK.

Health/Medical data

This is what British Airways says about their requirements:
"Employees who work with children and/or vulnerable adults, and those who require a permanent restricted zone ('Airside') security pass, are legally required to produce a satisfactory criminal record check."

This describes UK law:
Legislation controlling access to restricted zones at all UK airports (known as 'airside access'), requires British Airways to carry out additional background checks for all new applications for a permanent restricted zone 'Airside' security pass, including references covering the last five years of your employment and a criminal record check. In addition, in compliance with existing legislation, for these roles British Airways is required to ascertain your suitability to work with or be in sole charge of children and/or vulnerable adults.

To comply with the above, you are required to successfully complete a Criminal Record Check at Enhanced Disclosure level before you can commence employment with British Airways. This is in addition to obtaining references covering the last five years of your employment. The Disclosure can be obtained from the Criminal Records Bureau (CRB) and will be checked against disqualifying criteria.

As a new entrant into the company, you may be required to pay for your Enhanced Disclosure. For further information see the CRB website at http://www.crb.gov.uk/

I don't know where to direct you for the information, but I must say, I'm sort of surprised they only go back 5 years. Personally, I'd be more comfortable if it were 10+. After all... 9/11 was 6 years ago.

Who cares if there's a regulation? Why can't your firm just say that we're going to do a 5 year background check on EVERY employee. You have to clear it to work here. Seems fair.

I think the rehabilitation of offenders act is outdated to say the least.Why should someone who may have a conviction going back 25 years who has kept his nose clean and may have made a genuine mistake when young be penalised for the rest of their life.If you have been to prison for upto 2 and a half years you do not have to declare it after 10 years i believe but anything over that stays on record for life.How can they expect people to become rehabilitated if they are going to be branded a criminal for the rest of their lives and be penalised in so far as not being able to gain any employment.No wonder people revert back to crime if they may have done a prison sentence of more than 2 and a half years as most employers carry out CRB checks in this day and age.If these people are not allowed to gain employment and earn a living what option is left available to these people who eventually may think ,well if the shoe fits might as well wear it ! No other option is left available.No matter what you may have done ,if you have kept out of trouble 10 to 15 years you should have the same right as the person who done a 2 and a half year sentence.Does it make you any more of a criminal if your sentence is over 2 and a half years ? Criminalising people is discrimination at its worst. !!
