I don't believe this is legal. Please confirm. Is 6 Days Mandatory for Salary Employee Legal?
Every salary employee here have to work 6 days because our boss said so. Is this legal?

It is legal as long as the job is a truly exempt level job. Exempt means exempt from wage and hour OT laws.
Manager, high level specialist etc.
If it's a short time deal (few weeks or months) then work it and get through it. If it's like that all the time then I can only imagine what the turnover is like there. |

in the US...YES for salary, hourly, commission it does not matter.
in a few (very few) states there are laws that mandate one day off in seven but there are no such federal laws.
exempt status has NOTHING to do with the legality of being scheduled six days in a week. exempt status only applies to the payment of applicable wages or overtime.
as long as you are paid appropriately working six days a week is totally legal. |

Of course it's legal. The company gets to set the rules of the job, not the employees.
BUT... unless you meet the rules to be exempt from overtime laws, they'd have to pay you OT pay for hours over 40 per week. Being salaried doesn't automatically make you exempt from OT laws. |

Of course it's legal. An employer can require seven days, if he wants. Your question should be if you are considered exempt from overtime or not -- not simply paid via salary. You should visit the government website to see if your boss has catagorized you correctly as exempt from overtime ... http://www.flsa.com/coverage.html -- if you aren't suppposed to be exempt, then you will at least get overtime pay for any hours worked over 40.
And, frankly, with the economy as it is, be glad you have a job. Many don't. |
