A question about my salary?
Find answers to your legal question.

A question about my salary?

I am a salaried employee who works a compressed shift of three twelve hour days. My employer only pays me for 36 hours but I think since I am on salary I should get paid for 40 since I am not missing any time due to sickness or such.

your employer is only required to pay you at least minimum wage.
it does not matter if that is hourly or salary.

if you work more then 40 hours in a week you must be paid overtime even on salary unless you fall into one of the exempt categories which most jobs don't.

if you have changed your schedule from 40 hours a week working 5 days and that is your concern then there MIGHT be an issue. it would depend on whether the change was made for your benefit or the employers and if the change is permanent or expected to be.

if your employer just does not have work for you some weeks so you work less then your pay can't be cut 4 hours.

if your getting paid for how many hours you work, you arent really salaried then, are you?? i believe salaried employees get paid the same amount whether they work 36, 40, or 60 hrs per week. your contract should say whats expected of you and if you dont feel your pay is adequate, try to renegotiate your contract.

also, i wouldnt complain too much about being paid for the hours you work....only seems fair that its done that way......

How many hours a week are you working?

I think it's great when employers pay folks for 40 hours when they do the 3-12 hour shifts...but I don't think you can force an employer to be generous.

I would love four days off a week.

sounds like your getting paid for what you work....not a bad deal if you ask me.
