i am a waitress, and i fell at work the other night due to another employee's neglegence. i landed real hard right on my tailbone. it hurt but at the time i felt that it would be okay and i signed a refusal of treatment report. after sleeping a few hours i really hurt!!! my back is stoved up pretty bad and my right hip has pains shooting down my leg and up to my neck! WHAT DO I DO??? i don't have any insurance and do have a previouse injury there. i have to work, they didn't evn give me the next day off! i had to practically beg to go home after the fall! any advice??

What you signed was a waiver refusing treatment so if there was any injury and you decided to continue working they wouldn't be liable if you further injured yourself. I would go to a doctor immediately. Although you signed the waiver you would still be entitled to Worker's Compensation pay if you have to be out. |

tell them at the time of the fall it did not hurt but now it does and you need to see a doctor they have to send you and if not go any way tell them it happend at work they will take care of it from there |

Get a copy of the report (if you don't already have one). It should specifically say that you refuse any future treatment for them to deny it to you. It probably just says that you refused immediate treatment, and that is to cover your employer's butt. You need to read it more closesly and tell your manager that it hurts now and you want to see a doctor. I don't know if they can prevent you from seeing a doctor and filing a workers comp claim, I think it depends on the wording of the paper you signed and the laws in your state. |

you could try going to your doctor and getting a letter from him/her stating that your were injured in the fall. don't know if would help or not now. some friendly advice for the future though. even if you don't think you might be injured ALWAYS get checked out. injuries don't always show up for 24/73 hours after after they occur. |

Get a lawyer who will work for a percentage of the compensation award imediately! You may have been, (and probably were), in a state of shock. Ask the lawyer to recommend a good Doctor. Your back is your best friend and your future happiness could be jeopardy more than you know. Either way, you will most likely have to move on to a better employer. Make sure you can move on because your back is your only support. Your employer could care less! |
