I live in California and, in October 2001, I was convicted of a felony, doing exactly one year in state prison and coming home in October 2002. It's something that is very explainable -- no one believes I should have had to deal with any of it -- and has not hurt my professional or personal relationships much at all. I'm a white collar professional in the tech industry.
I'm currently searching for a new job and 75% of the job applications ask whether you've had a felony or not. I've been told that you only have to disclose it if it happened within the last seven years. Does anyone know the California legalities behind this? It's something I plan on disclosing anyway, but only once the interview process has begun. Any help would be appreciated.

Do not check the 'no' box. Leave it blank. Hopefully they won't notice (but having YES checked where they are looking for NO is very noticeable, especially when it comes with the explaination they ask for next). Then if you disclose this during the interview, you haven't done anything dishonest. |

Don't not answer the question and absolutely don't check no. Say yes and then explain it. If they don't have room for an explanation get you an extra piece of paper and explain it in the shortest possible way, (a longer explanation can be given later to a manager or human resources) most companies will allow this some even say so on the bottom of the application. the only questions you can leave blank on an application is salary desired and salary received at last job, because the first is negotiable and the second doesn't have to be told. |

Nearly all companies will run a background check on potential employees. They will find out about your felony. If you don't list it, they consider it lying and will question your morality and most likely not offer you a job. |

Most all companies do a background check now..........they will find out..........might as well be up front...........your in a bad situation.........thousands and thousands of highly trained, highly educated men and women with spotless records looking for a job to pay their bills.........any job............good luck. |
