My employer is starting need regulations this coming year including age based vacation. Meaning the older you are the more time off you get. I feel as though this is illegal based on age discrimination how should I go about presenting this kindly to my HR, preferably in a email. Any additional laws to use as an example would be helpful. Thank you. Additional Details Not need regulations new regualtions sorry for the confusion

I'm not sure I understand your question. What exactly are "need regulations"?
What you may want to do is ask HR for clarification on the policy. It's common for people who have worked for a company for a longer period of time to have time off benefits that grow with their age in the company. If you find that is not the case, and you are in the US, then go to www.eeoc.gov and click on "Age" under discrimination and it spells it out pretty clearly. Taken right from their website:
The Age Discrimination in Employment Act of 1967 (ADEA) protects individuals who are 40 years of age or older from employment discrimination based on age. The ADEA's protections apply to both employees and job applicants. Under the ADEA, it is unlawful to discriminate against a person because of his/her age with respect to any term, condition, or privilege of employment, including hiring, firing, promotion, layoff, compensation, benefits, job assignments, and training.
It is also unlawful to retaliate against an individual for opposing employment practices that discriminate based on age or for filing an age discrimination charge, testifying, or participating in any way in an investigation, proceeding, or litigation under the ADEA.
The ADEA applies to employers with 20 or more employees, including state and local governments. It also applies to employment agencies and labor organizations, as well as to the federal government. |
