Would you say there is a case for age discrimination/bias if you completed the same training program but was always passed up for promotion by candidates who were younger than you? I am over 45.

I would keep a journal of every time it happens and ask your boss directly if that is the case, then listen for any rumors that may be going around about you, It's possible that this is happening.. And if it is you can definitely sue them for Age discrimination.. Just have all your ducks in a row first, don't go at it with a blind eye. |

If YOU were the only person effected I would say no - if there was a pattern involving many folks over 40 then yes
Personally I would have a cordial discussion with my direct supervisor on why "I" did not get promoted
This may/should evolve into a discussion on where your performance may be lacking |

Was this a corporation / or statutory trust? They DO NOT have UNalienable Rights and therefore DO NOT have the 'right ot contract' with whomever they choose.
They are legal fictions and thus have to abide by statutory regulations. However, men /women have the Right to contract w/ whomever they please. Again, it's their UNalienable Right to Contract.

Only if there is a pattern of many older people being passed over in favor of less qualified younger candidates. The first thing to do is see the union rep or equal opportunity liaison. An employer may see other competencies such as interpersonal skills that you do not.
On the other hand, a class action suit carries a lot of clout. If many people are being affected, the courts will intervene. |
