I live in California and I was 16 when I was caught shoplifting 5 years ago with my friend at Target. I BELIEVE the merchandise I stole (CDs) were under $50 because I stole four. The cops came and got our information and took us home (no handcuffs or jail time). Later I received a letter in the mail issuing what I think was a court date. Again this was 5 years ago so my mind is quite blurry. I went to the City Hall and waited in a room with other minors. I remember the building floor was a misdemeanor floor. Well, they called us in a courtroom in groups of about 5 and they said for us to wait for our names to be called and if they didn't call our names I guess you were dismissed. My name wasn't called but they made me pay a fee. The fee would've been greater if I didn't take this one day class where they make you write essays and such. I'm trying to be a card dealer right now and they said that if I had a misdemeanor offense for the past 10 years on my record that I'd be automatically disqualified from getting hired. The truth is, I don't know if I do or not. I went to the city court again to check and they said that they didn't have anything on me but I should go to another floor. So was I charged with petty theft infraction? What IS it exactly? Is anything on my record? When will it be cleared if it is? I heard that if you were a minor, it should be cleared. I don't want to waste my time if I did have something and it would disqualify me. Thanks a bunch.

usually when you have committed a crime classified as a misdemeanor they will allow you to take a diversion class (which you did) and/or pay fines. especially if you were a minor. but it has to be your first offense so it can be removed from your record. it sounds like thats exactly what happened with you so i doubt its on your record and i wouldnt worry about it showing up. good luck! |

Regardless of the issue that you were 16 years of age at the time of the shoplifting charge, go to your nearest courthouse and conduct a search for your name on their computer database going back at least 10 years and if your name comes up, you may have a problem. If there's no search result whatsoever under your name, you are home free.

I don't know but I think you should proceed as if you do not have a record and try for the job. If you are disqualified then you will know that it is still on your record. It sounds likely that it is not. You were not convicted or given an opportunity to plead. Unless you signed something where you plead guilty then you have no conviction. It sounds to me like the system was just too busy to handle your case and they probably let you off with deferred adjudication. This means that if you stay clear of trouble for a period of time then the case is dropped. If you had been charged with another crime afterwords they would have the option of reinstating the original charge on top of the new charge. |
