Am I entitled to back wages?
Find answers to your legal question.

Am I entitled to back wages?

I work for the University I attend. I was due an evaluation for a longevity raise of $0.50 at the beginning of this semester. I informed my direct supervisor and she told me that she was "looking into it" Well here it is the beginning of March and I still haven't had my evaluation in order to get my raise. I finally have one scheduled for this week and I'm wondering if I'm entitled to the money I would've earned had they done my evaluation when they were supposed to? Its a longevity raise so there is really no disputing it so I figured that I was entitled to the extra money.

No no no, I'm not asking if I'm entitled to the raise. (I'm basically already assured the raise) I'm asking if I'm entitled to the money I would've made had they done my evaluation on time. Nothing has occurred that would've prevented me from getting it in January so I don't see how they can penalize me for them not doing their job.

Am I entitled to back wages?
NO albeit many employers will do raises retroactive they are not required to unless you have a contract that addresses the specific issue.

and unless you have a contract that addresses the issue you are not entitled to the raise either.

dont count on it

No, you aren't entitled to it although you can ask and they might give it to you. They aren't legally required to give you a longevity raise even if it's in the university policy.

My experience with these kinds of things is that they DO apply retroactively.

After all, it's them, not you, behind the delay.

Assume they'll automatically do this. If not, then bring it up with the appropriate person -- whoever deals with workplace issues.
