Am I wrong? or is my boss wrong?

My boss doesn't give anyone breaks. Weather it be 4 hours, or 8, we don't get breaks. If we work overtime, the hours roll into the next day, and he will send us home early the next day. He verbally harasses us every day in front of our customers, and makes every employee look retarded. I work (worked) for Quick View / Quick Test / Heakin. This is a market information research company. The specific building is located at Puente Hills Mall 1600 Azusa Ave Space 386, City of Industry CA 91748. Ive worked there for a total of 4 days. (working days) but have been employed for about a week. First day and second day went well. First full day of work he chews me out in front of coworkers and employees, because he throws me into the work, without any training on what im supposed to be doing. The next day I show up with a blemish on my neck (hickey) and almost completely unnoticeable. When I ask him about it, he sends me home. (this was supposed to be a day I didn't work, but he asked me to come in, and i agreed to come in) While sending me home, he makes me feel like an idiot for even coming in there. The next day i work 7 hours. No break, everything goes fine.I tell a co worker that I'm considering turning him in for how he treats us. The next day before work Im waking up in the middle of sleep covered in sweat. I call him 2 hours before work and let him know im not feeling too hot, by saying "hey scott, im sick, I - " (completely still willing to work, i need to know his situation and if he still wants me to come in) and before i can get anything else out he replies with "You know what, I dont think this is working out, its too hard to get you to come into work" I hang up on him.

I guess what im asking is - is he right for firing me on these conditions? I have a strong feeling that this is because the other co worker told him i was going to turn him in for unfair work practice.

the reason i told my boss about the hickey was because i am a very open person, and if im being employed, i feel my employer should know everything. it wasnt a - hey i have a hickey, can i go home? and also - has anyone ever head of quick view - quick test - or heakin? you might know it better as people with clip boards walking up to you in a mall asking you if you want to take a survey

While your ex-boss clearly has some "bad boss" issues, I'm afraid you did give him every indication of not being a reliable employee, and whether he was a good boss or a bad boss, either would have fired you. With the economy being the way it is there are 20 people lined up for every job, why waste his time on one that wants to stay home every time they have a hickey or forgot to turn on their air conditioner before they went to bed? Bosses don't care or want to discuss your every sniffle, they expect that unless you are literally too sick to get out of bed and come in to work that you will be there, prepared and ready to do your best, all on your own, without them holding your hand. Talk to your boss only when there is a serious problem, or, when something job related requires you to. Being too sick to work should only happen once every 6 months to a year at the very most, and if it happens during the first month or even two it looks like your nothing but a slacker hooky player. Hinting at your boss every single day about some strange anomaly he doesn't care about just makes him think you want to go home and are all of the above.

My question is, why in the world would you TELL him about the hickey if he never inquired about it?

Also, you didn't carefully choose your words in calling him the day you were sick. Starting it off with "I'm sick" doesn't bode well with anyone in the workplace, it seems like you're just making an excuse by starting it off that way.

He should have given you more practice, but it's a boss's job to be harsh to his employees. As long as he wasn't actually harassing you or anything.

Hm I don't there are any laws requiring breaks, except for minors. But it may vary by state. Although in my mind, it's best business practice to give breaks to employees. As for public chewing out, well, that's not illegal but it's poor management. Just be glad you're out of there.

In the USA an employer can fire you for just about anything. And there are no mandatory breaks unless you belong to a Union.

Read the rules for the workplace. Every company should have them. Also, I think breaks are a federal law. You can always go consult a lawyer. A lot of them will hear your case before charging you anything.

I swear...it does not do me well to be as bull headed as my boss! I'm beginning to think she likes butting heads with me! Oh well...like me or not...the office is in positive numbers again...and it hasn't been since this time last year. When I took that office, it was 5 digits in the hole per month. Another worker showed of too me so I had him print it and sent it to my DM so I could fire her!
