Am i entitled to holiday pay after being dismissed from my job?

After working for the same company for the last 3 years, would i be entitled to any holiday pay which i haven't used this year, bearing in mind i have now been dismissed from this job?

Yes as long as you weren't dismissed for gross misconduct. If you are in the UK check out ACAS, if in another country check with your alternative. But yes you are entitled to the holiday accrued in financial re numeration!

That depends on company policy. There may be some local laws that affect this also. In the absence of a law, the company can set their own policy on this.

Where are you? In the US, not in most states, although many employers might give it to you anyway but don't have to.

Yes - it should be in your final pay packet.

No you are not entitled unless you work the day before and after the holiday. It does not matter if you have been there for three years. If they let you go before the holiday then no you are not entitled to it either.
They only thing they need to give you is your pay for the week and any accrued vacation time.

Read the policy handbook if you still have it, it should explain the termination policy as well as any holiday pay.

Holiday pay is a voluntary benefit that companies give to their employee. It is not mandated by and State or Federal Regulation.

Yes. Any leave that you have accumulated will be paid.

Yes. Upon leaving employment you are entitled to all holiday pay which you have accrued, regardless of your reason for leaving.

No! Holiday pay is a benefit of working for the company. Once you leave, by choice or them firing you, you are no longer entitled that benefit.

Hi im had a paye employee working a probationary period of 6 months, however 5 months into her probationary period she refused to sign a contract resulting in me giving her one weeks notice....she is now claiming that she is entitled to holiday pay please can anyone advise me. Thanks
