when i was fired from my job i tried to get unemployment and they said i couldnt cause i was fired for being insubordinate and showed misconduct. i appealed this cause i knew that i was not fired for that and i won. i tried to get hired at the same restaurant just in a different place and they said that i was on the list of ppl they could never hire again. i wanted to know if i could sue for defamation of character because that affects me when other jobs look at that even though i was not insubordinate.

Can you sue? Sure. Anyone can sue for anything, but be warned there are no laws in any state that prevents an employer from saying anything negative about a previous employee. However, in your case you can consider the following. Secure an employment attorney who can possibly pursue legal grounds for a wrongful termination and retaliation. Would take some spin doctoring but a seasoned attorney should be able to succeed. You are seeking for an attorney to write a cease and desist letter to stop the negative reference, as well as, seek monetary compensation for preventing you from seeking other employment. The fact that a governmental agency found (UI investigator) you were not terminated with cause and actually found it was a "constructive termination" (no fault on your part) should reinforce the argument of a wrongful termination, etc.... This is not a case that will lead to any court proceedings. You need an attorney to basically put the fear of God in them and compensate you for the job loss and loss of earnings since your termination due to the negative and unsubtantiated cause for termination.
