if i had full time benefits (80 hours payd vacation, 40 hrs paid sick) for 10years, even though i was never a full time employee, can it just be taken away from me for no reason?
i average 30 hours a week for the past 10 years when i tried to take a vacation, they said i wouldnt be paid.
is this legal?

The time you have already earned cannot be taken away from you. However, the employer can stop those benefits and you won't accrue the vacation and sick time. If you have no earned vacation time, then you wouldn't be paid.
Check the current employee handbook - it should be listed in there. |

Were you a non-exempt employee? If you are not billed as a full time employee (regardless of how many hours you work) you are not eligible to receive vacation time in CA. Some private companies do their own thing w. thing, but state law says you must work a minimum of 37 hours a week to be considered full time and your company must "code" you that way in their system.
There is nothing illegal about that at all. |
