Anyone know anything about the ada law?

my gf was threaten to be fired today from her job. she had asked her boss for a sign lang interpreter for the meetings so she can know whats being said at the meeting...he said he wasn't going to give her one and she said she wont show for the meeting since he wont provide her one...he also said it was never a problem before but it really has..my question is can he fire her for over that? i had also found out that her boss told her that he will with held her paycheck if she doesn't show up for the meeting...can he really do that?

she can do her job just fine...its just during meetings she cant hear whats being said or what changes have been made or complains or whatever the meeting is for..she has told him in the past that she needs one and he told her today that he knows the law and is still refusing to get her one...he even said he hired her sister to be the interpreter but she isnt qualified to be one..

That is the Equal Employment Opporunity Office and definitely file a formal complaint with them. Then I want you to contact your states Department of Labor at 1-866-US-WAGE and they will refer you to your states wage & hour law division against this illegality. Then go to an employment lawyer. Not a labor attorney. An employment lawyer. If they do not take this case on contingency (for free) not worth being your lawyer unless you are leaving other facts out. By the way I left out. The first poster was going on about reasonable accomodations? No. This is beyond reasonable accomodations. Read ADA laws before responding in this particular area!

The question comes down to reasonable accommodation. Is it reasonable to insist that an employer must provide an interpreter so she can perform her job?

Post #3 is telling you good info, but from an HR stand point she does need to continue to attend the meetings. She does not want to give them any reason to write her up for insubordination. Definitely file a complaint w/ EEOC in your area, look them up online for a local office and file a complaint, they will do and intake over the phone and then they will send you paper work to fill out and then set up and appt..

Good luck and do not let them so this to her.

Apparently, her boss does not know the law very well.

Hiring an interpreter does not cause undue hardship on a company. She has every right to be accommodated. He cannot with hold her check for not showing up for a meeting that apparently she cannot understand without accommodations.

I suggest that she puts her request in writing such as an email so it can be traced back to the employer and proof that the employer was in fact notified of her accommodations numerous times. If they do not accommodate her she will need to go to the EEOC and file a claim of ADA discrimination. I would also suggest that she brings in the email that she sent requesting it and any other correspondence that she may have with management relating to it as well.
