Appeal against dismissal. Job already filled!!?

I was dismissed from my job for gross misconduct on Tuesday 4 November. I have 7 days to appeal, so the time hasnt run out. I am going to appeal as I dont agree with the decision.

However I found out yesterday that they have already offered someone else that worked below me the job and they have accepted!!

Is this lawful? What should be my next move?

The job still has to be done. Dont worry about who is doing it in your absence. Just file your appeal and go from there. But document the fact that the position was filled within 3-4 days and by whom.

Sure, they can put someone else in the position legally.

Sounds like your next move would be to appeal.

You can be fired for any reason..and of course they can fill the position.

You need a huge does of employment reality. Most Americans have zero clue how little employment protection they have.
They owe you nothing.

Get a better attitude of what you can do for them, then go over your excellent history and hope for the best in your appeal.
