Applications, Differed Judgments, and Expunged Charges?

I was recently filling out an application which reminded me of a question I've always had; when you're prompted to list your criminal record on an application do you legally have to include infractions which you received a differed judgment on or others which were expunged after a period of time?
I've always just included everything I have been in trouble for over the years since none of it was entirely too serious but I guess if it's unnecessary it would probably be better left unsaid.

The criminal conviction question on an employment application is not the same at every company. Sometimes, only felonies are requested; sometimes it is all convictions. Sometimes there is a time limit stated in the question. You should not lie on an application, since this is cause for immediate termination. But an expunged conviction is a conviction that is removed from the record (for most, but not all purposes) and you can truthfully omit any mention of a conviction once it is expunged.
I don't think most companies will be concerned with an infraction in an area like your driving record, unless your job involves driving. |
