i was arrested for shoplifting , which was false but the evidence was pretty much substantial to prosecute me...which they did....i talked with my lawyer and he made a deal....30hrs community serv....and 6 month good conduct and the case wil be dismissed........am only 19 and a recent immigrant ( 3yrs)..with a green card.....i am a good student in a top university and i would not want my life be shattered with a false accusation..............ok..my question is i want to apply to this security company with competitive wage and benefits....and when i went to fill thier application they stated if i have a conviction...which i dont but on page two they list arrests,pleas,deals,arraignments and other criminal process and they ask me to fill in any i have had any contact with.I was arrested almost a month...and my question is should i say i have not been involved in any of this or should i say i have been arrested but no deals have been done and the case was dismissed, could they verufy my claim.Plus do they use similar background checks as other co-operate companies or are thiers thorough and include the arrests,charges,court dates,pleas etc......what should i do...i dont know.......also how long does records of arrests are dessimated to background check companies....( note: it has been only a month since i was arrested......) please help me.

I am sorry to say, yes you do have a record. A conviction is also on your record. You took a plea deal to plead guilty, do a diversionary program, and get it expunged from your record. Even if it was to be erased 1 month is not enough. My son got arrested once for a charge that was bogus too. I wrote to him, and told him take no deals, but he said he didn't got it on time. And now it is on his record. The person that called is trying to make his life hard. I told him all she had to do is pick up the phone, and he is done. And she did, and even though it was counted as his first, no more deals, and no more chances. The snetance was the same, but now it stays on his record.
In your case it is always better to be honest. More so, cause a security company does not play when it come to background check. It would be ashame to get hired, and the get let go for lieing. A deal is a conviction, but i addvise that you also write will explain at time of interview. Let them know you are young, and was scared, and take all plea bargan paperwork so you can prove what you say.

They may see that information but usually an application will ask and have a section where you explain yourself. It's up to the company to do more than just look at it on the surface and hire you or not hire you or do more research...At the end of the day, it's the person hiring's aopnion and assessment but again a guard position and the "crime" was shoplifting...? I think you should try something different. It's just not ideal for someone to overlook that...I don't know, just my 2 cents! |
