Are Hss hire shops acting fair?

I am a branch manager at a hire shop and was told i heard rumors after coming back from holiday that someone was taking my job, i straight away phone my area manager who reassured me i was not to worry. Today he contacted me and said we have given your job to someone else my old colleague and he has excepted, i have a choice to demote and work with him or leave. i feel that i am the last person to hear about it as the rumors have been around for weeks. Do i have any rights in this can they do this is it legal, It all seems very sly and back stabing. please help me thanks.............

contact your state dept of labor and see what they have to say to see if it might be a discrimination case

I dont think they are allowed to do this.

do you have a contract of employement that says your job description is a branch manager? if so, you have a very
good case.
you could also and sue for constructive dismissal if you were to leave as you did not want to work for someone who basically has taken over your job.

I would definitely seek advice as this doesn't seem legal. If the company do not feel that you are doing an adequate job then they should have called a capability hearing to discuss with you where they feel your failings are, and how they can be improved. This hearing is also necessary to allow you to put your side across, i.e. if you haven't had enough training, enough staff, etc.

Following a capability hearing a company should then give you targets to meet to show improvement and set a review within a reasonable time frame (i.e. they shouldn't expect it to be within a couple of days, though they would be reasonable to ask for your proposals for improvement within a couple of days).

What is stated in your contract of employment? If it says nothing about demotion what basis have they demoted you for? Ring employment tribunal service and check this is allowed.
