Are employers allowed to disclose your salary to a new, potential employer?
Find answers to your legal question.

Are employers allowed to disclose your salary to a new, potential employer?

I am searching for a new job. Sometimes the application will ask for you to provide your current pay/salary. Is there a way for this infomation to be verified?

Judy
Previous employers are allowed to give any info that is true. Many people think they are limited to verifying that you worked there, and maybe whether you were eligible for rehire - this isn't true.

And you need to know because?

The company I used to work for *always* verified salary. If they found a discrepancy (like you claimed a lot more than they could verify), you had to bring in a paystub to prove it. Otherwise the job offer was taken back.

Yes, I do believe they CAN verify it.

They will call your references and ask.

There is no law limiting what a former employer can say. They can say anything they want as long as it's true.

Many companies have a policy to ONLY verified employment dates, salary, and eligibility for rehire. But this is NOT a law.

If you lie on your resume/application about your previous salary, you run the strong risk of losing that new job when they catch the lie.

it depends on the contract you signed but i highly doubt they would give a range for the salary

One of the few things an ex employer will share:

How much you made an hour/salary
How long you worked for them.

And they usually only answer one other question:

Would they rehire you? And the Answer will be YES or NO
No other details will be given.

Legally, all a former employer can do it confirm or agree to what the potential employer says you put on the application. When they call to verify you employment they'll ask if you worked during the particular dates and made a particular salary. Sometimes the former employer won't say anything. Then again, there is a chance they won't follow the rules.
