Are my rights as an employee being violated?
Find answers to your legal question.

Are my rights as an employee being violated?

I work in the dental field at a lab where we make dentures and crowns and other things for the Doctors. Most people are on peace work( where you get paid by the peace, each thing you do is worth a certain amount and the more you do the more you earn, if there is enough work). I am on hourly and do quality control. The manager cut the peace work nearly in half when we were already getting slow. He comes up with new things every week that he wants us to do. Basically asking us to more and get paid less. I have discovered he wants to get us all to quit or he is going to look very very hard for excuses to fire us so he can hire new employees that work for less money. Today myself and two others were set up to look like we were the cause of some things that went wrong with some cases. I was able to prove that my department and everyone in it were not the cause and he and the other supervisor ignored it and two peoplew were given written warnings anyway. I know for a fact what he is up to because I am basically a supervisor myself and get privaliged information. To top things off when I was on peace work I made more money than I do now. He gave me an ultimatum forcing me into this quality control position and promised me a lot of over time to make the same amount. After two months of 65 hour work weeks just to make what I was making in 40 hours he cut my overtime out comepletely. There is a lot of detail I still have not gone through but based on what you have read, what can I do? With the bad economy jobs are almost impossible to find especially in southern California, and I have a daughter and out of work fiance to support. But I can't take much more of his abuse, and besides eventually he is going to achieve giving me three write ups based on false accusations and I will lose this job anyway. Can I fight this? And How?

Do your job to the best of your ability.................
The employer is required to pay at least minimum wage and applicable overtime and nothing more (it does not matter how that wage is determined, commission, piece work, salary or hourly).
Keep a record of your work and if you are terminated this may help prove the employer did not have cause. If they don't have cause to terminate you then you will qualify for unemployment insurance.

There is no need to fire people so lower wage employees may be hired instead...the entire employer has to do is give notice and lower the wage. Pay decreases are not illegal and do not require agreement of the employee.

This all assumes that you are working "at-will" and not under contract.
It also assumes you meet all the other criteria to qualify for unemployment insurance.

As far as unionization as mentioned earlier just look at what unreasonable union wages and work demands have done to our industrial base and in particular the auto industry. Employment contracts and unionization is not the answer to bad or unreasonable work conditions.
Unions that now fight against the right to work have killed themselves, not "at-will" employment practices.

EDIT for 'by Republican's Booo':
If the lives that our workers have were so bad Europeans wouldn't be begging to immigrate and WORK here.
Go look at the lifestyle and living conditions of European workers and then tell us how they are laughing at the US workers.

Even in our worst times things are better here then anywhere else in the world (for the working man/woman)

Based on your question and assuming it's all true, it might not be very ethical but there's nothing illegal there. Sorry.

Hum not sure there is anything you can do other than keep a log of what is said and done and hope that everything goes ok. More importantly the people of America need to start unionizing again this at will employment allows companies to do these things to us (along with the 1 week vacations a year). I might add that European countries laugh at us because we are over worked and under paid.
