Are there any laws on getting paid by your employer on time?
Find answers to your legal question.

Are there any laws on getting paid by your employer on time?

I have tried to find out information on the department of labor website but can't really find anything to answer my question.
At the beginning of the year my employer went to paying by direct deposit. Prior to that we would receive pay checks every friday. When the direct deposit first started we would usually have it on Saturday because he did the payroll on thursday nights. Now sometimes we don't get our money until the following WEDNESDAY! It is very frustrating and I was just wondering if there were any laws regarding this. I am in Florida if that makes any difference as far as laws state to state

Florida currently has no statutes concerning pay-days.
Florida is one of a few states that have almost no labor laws.
(laws form other states have no relevance in Florida)
(Florida did mandate pay-days of at least once a month through 2007)

Federal law does not mandate when pay-days must be or how often.
(ERISA has nothing to do with labor law, ERISA regulates when and how employee benefits and pensions are paid)

Florida courts have held consistently that once an employer has established a pattern for pay-periods and pay-days they must follow it and can not change the pay-periods or pay-days without prior notice.
in Florida your only recourse is to seek legal counsel if the employer is not following their stated policy.

speak to the employer about your concerns and get a commitment as to what the policy is and if need be take civil action.

There are absolutely laws about that, but there are also laws that allow a certain amount of working days after the pay period ends. Those laws vary by state, but I believe there are also some federal laws that may come into play.

Honestly, it sounds like your employer is within the (x) days window, but do a little more research on the specifics. I'll put a link to one state's Dept. of Labor to give you an idea. There is some interesting information here.

Edit: I'm the only person who provided any reasonable proof of my answer and I got a thumbs down?!!

With no legal expertise other than the experience i get from working at 1 of the worlds biggest employers in the package delivery business not named fed-ex i will state my opinion.

If your employer is struggling to pay his bills, problems may lie ahead.

If you complain about your workplace you may just make things harder on a company tryin to pay its bills

If you complain to a govt agency you will be paid before they are investigated therefore there will be nothing to investigate really. You know govt.

And lastly, ask hr or payroll dept.Get an honest answer.Maybe its a glitch.Maybe the employer is struggling .I guess i would be frustrated too if my paycheck was deposited 3 days late every week but i doubt any action would ever be warranted.

Besides if you complain too much your employer may just change policy and pay you bi-monthly or monthly.

Just ask .Good luck

There are federal and state laws that require prompt payments of payroll and all employee benefits. Start by talking to your employer. Maybe your bank is putting a hold on the deposits instead of your employer being late. If he is randomly delaying, he is violating laws. The very bad news is that it is an early warning sign that he is cash strapped and that his bank is not sending the wires until his funds have cleared. There are three choices: 1) he is negligent about following ERISA laws and has no concern about his employee's expectations; 2) His cash flow is inadequate to cover all of his obligations and he is needing the extra days for delays; and 3) Either way, his fines from the Fed and the State will further complicate your problem.

Solution: Start looking for another position with another company immediately.
