Are there any legal issues with having to complete a new Application form for an existing job?

My wife is a Careworker, who has recently received a memo from her head office. The wording on the memo states "Due to recent inspection all carers are required to complete a new Application Form and Applicant profile for their personal files as a lot of information seems to be missing". With the requirement for them to be completed and returned by 30/11/07, when they were only received on 23/11/07.
Obviously she along with all her work colleagues are both bemused and concerned. This being compounded by the fact that earlier in the year, it was stated that around October time (still waiting) new contracts would be issued. Their concern is that this might be a way of introducing those new contracts and wiping clean the years of service already gained. Any thoughts or suggestions?

Hi - I work for a care company, and to me it sounds like the inspection has picked up on areas where the company isn't meeting the Care Standards Act 2000. This Act covers pretty much every area of the care industry, including recruitment practices, and what information you have to have about staff. One of the things it stipulates is that companies must hold full employment history for all staff, with no gaps. Also, saying you had a job from 2000 to 2005 isn't enough, the inspectors demand that the months are given as well (e.g. July 2000 to May 2005). Any gaps, even of a month, have to be accounted for. To me it sounds like this is the information they are trying to get. Anything regarding changes to contracts would need to be done through a consultation process - they won't be able to bring these in through the back door just from someone submitting an updated application form.

Be aware that because it is a legal requirement for care companies to hold this information, any employee refusing to give it can ultimately be dismissed.

missing information? careworkers as you know are highly vetted . where is the missing info? she should have her union rep investigate. this happened to a friend of mine. she found herself on the receiving end of a highly reduced pay packet and lost holidays. legally she must comply, a week to reply sounds a mite suspicious , the info required must have been urgent and necessary. not much help for you here i'm afraid. maybe the new contract will be ok. hope so....

hi if there is information that needs adding to personel files the it only needs a questionaire do not fill this, form in but go and see union official.
